I was recently at the CLEAT convention, and they had worker comp training. I spoke to Amy, our trainer, and this is what she had said. Please see below.
I checked Travis County, and they do not have a filing with the state saying they have a network. That means your members can choose any doctor to be their treating doctor as long as that doctor accepts workers' compensation.
Just keep in mind that if they go to a doctor that the employer recommends and receive treatment for 60 days, that doctor defaults to be that employee's treating doctor.
An employee can change their treating doctor, but they will need to get the Division of WC (the State) to approve the change. Here's the form if you need it: DWC Form-053, Employee Request to Change Treating Doctor [tdi.texas.gov]. They need to find a new treating doctor first and get that doctor to sign the form before submitting it.
Below is the packet an injured worker would receive from the Division of WC once a carrier reports a work injury.
The second attachment is the form I mentioned that needs to be filed within 1 year of the date of the injury. It needs to be sent to the Division (not the employer). It can be faxed to 512-804-4378 or mailed to PO Box 12050, Austin, TX 78711. I recommend faxing it and saving the fax receipt.
The third attachment is the rights and responsibilities document that lets the worker know about their right to choose doctors, hire attorneys, etc.
